Summary of Proceedings:
This
matter came before the Planning Board on the application of Mikan
Realty Trust, Michael Thompkins, Trustee (Applicant) for a Special
Permit A1 under §III-A, 4.14A of the Zoning By-Law, along with Site Plan
Review and a Parking Determination to be done by the Planning Board,
and such other relief as necessary to maintain a storage trailer to the
rear of the building at 194 Lincoln Street in Business District B.
The
Planning Board and the Zoning Board of Appeals jointly heard the
application at a duly advertised and noticed hearing on December 19,
2013 at 9:00 PM in the Hingham Town Hall at 210 Central Street. Members
of the Planning Board present were: William Ramsey, Chairman; Judy
Sneath; Sarah Corey; and Dick Cook, Alternate. The Applicant was also
in attendance.
Members of the Zoning Board of Appeals were: Joseph W. Freeman, Chairman; Joseph Fisher, Clerk; and W. Tod McGrath.
Project Description and Findings
The
premises consist of approximately 18,500 square feet. A zoning
district boundary bisects the property, with the westerly portion of the
lot falling in the Business B District and the easterly portion in
Residence A. There are two buildings on the property. The first is a
two-story mixed-use building (commercial/residential) and a two-story
dwelling. A storage trailer, used in conjunction with an electrical
contracting business operated by the Applicant, is located in the
Business B District and is screened from view by the mixed-use building
and an arborvitae row.
The Zoning Board of Appeals granted a Special
Permit and a side yard setback variance to allow a storage trailer in
this location in April 1993. The Special Permit issued for the storage
trailer was subject to annual renewal. The Applicant has not renewed
the Special Permit as required since it last expired in June 1999.
The
applicant stated this request is to continue to maintain the storage
trailer as presently located at the rear of the property, and he
described the site and stated the trailer was not visible from the
street. A direct abutter, Jeff Anderson, 190 Lincoln Street, said that
the lattice, which had been required by the Board to screen the trailer
in a previous approval, had recently come down.
The Board
discussed the appearance of the site and the existing parking of the
site. The applicant stated that there was more than enough parking on
site for the uses, and, that the trailer does not occupy any parking
spaces currently and will remain in same location.
Decision and Vote
It was moved, seconded, and SO VOTED to WAIVE site plan review with the following condition:
1.
The Applicant repairs existing lattice and plantings to screen trailer
from view to west and to north along Lincoln Street by or before April
1, 2014.
2. The Applicant is to report to Community Planning Department for inspection upon completion.
It was moved, seconded, and SO VOTED to APPROVE the Special Permit A3 parking determination.
