Summary of Proceedings
The Board held a duly noticed public hearing on April 11, 2016. Planning Board members present included Sarah H. Corey, Chair, Judith Sneath, Clerk, William Ramsey, Jennifer Gay Smith, and Gary Tondorf-Dick. The Applicant team included Robert Devin, Attorney, Andrew Manning, W/S/M, and Bill Hamilton, General Manager of Derby Street Shoppes. The Applicant also has a Special Permit A2 modification before the Board of Appeals. This was a joint Planning Board and Zoning Board of Appeals hearing.

Project Description
The Application before the Board at this time is a Request for waiver of Site Plan Review under §I-G and §I-I in conjunction with a proposed modification to the existing Special Permit A2 dated February 10, 2003, as amended, under §III-A 4.17, along with Special Permit A3 parking determination under §V-A of the Zoning By-Law and such other relief as necessary to allow a Capital One Café to occupy ~10,000 square feet of interior space formerly used for retail.

Attorney Robert Devin explained that this project has no exterior work proposed, and as such, the Applicant requested a waiver of Site Plan Review.

Findings and Decision
The Planning Board discussed the proposal and found that it was reasonable to waive site plan review because there were no exterior improvements or work proposed in conjunction with this application.

The Board then Moved, Seconded and SO VOTED to WAIVE Site Plan Review in conjunction with a proposed modification to the existing Special Permit A2 dated February 10, 2003, as amended, and the Special Permit A3 Parking Determination, to allow a Capital One Café at the Derby Street Shoppes because there is no exterior work proposed.
