RE: Christina Estates modification of the approved plans from conditions of the Certificate of Action dated 1/10/2000, recorded with the Plymouth Registry of Deeds in Book 19089, Page 223, modifications to the Approved Subdivision plans, and waivers of the Rules and Regulations
Plan Reference: Definitive Subdivision entitled Christina Estates at Baker Hill, Hingham, MA, prepared by Coler and Colantonio, Engineers and Scientists, 101 Accord Park Drive, Norwell, MA 02061 for Intoccia Construction, dated March 25, 1999, consisting of 71 Sheets, recorded in Plan Book 43, Page 1183, as amended by this Certificate of Action and to be recorded herewith.
CERTIFICATE OF ACTION
Background
This application requested approval for a modification of the Certificate of Action dated 1/10/2000, modifications to the Approved Subdivision plans, and waivers of the Rules and Regulations. The application was submitted on December 9, 2015, and was supplemented through July 27, 2016. The hearing opened on January 20, 2016, and was continued to May 16, 2016, June 13, 2016 and then to July 18, 2016, and July 27, 2016. The panel on this application consisted of William Ramsey, Acting Chairman; Judith Sneath; and, Gary Tondorf-Dick. John Chessia, Chessia Consulting represented the Planning Board as the Peer Review Engineer, and Susan Murphy served as Attorney for the Board on this project. The Applicant team consisted of Jeffrey Tocchio, Esq.; Tom Duggan; Tom Corcoran; Gabe Crocker, CHA; and Dan Saley, CHA.
Discussion and Findings
The Board discussed each of the requests separately, asking questions, reviewing the peer review engineer’s reports and recommendations, considering the Department of Public Works comments of July 11, 2016, and taking public comment. The Board then made findings and identified potential conditions specific to each request, as follows:
1. Request to Modify the Certificate of Action IV 13 - 4’ Deep Sumps in Drain Manholes: A waiver is requested from the requirement to provide a 4’ deep sump in drain manholes located within the street for DMH’s 1, 7-10, 13 – 16, 18 – 20 & 22.
The Applicant team explained that this requirement had been met in most cases throughout the development, with the exception of the locations as noted. To change out the structures that do not meet the requirement would degrade the overall integrity of the system, and, the project as built currently exceeds the Massachusetts Storm Water Management Standards.
The Planning Board made the following findings: The DPW does not require 4’sumps in drain manholes; deep sump manholes are not common and are not a Best Management Practice under DEP requirements; this was a condition imposed at the request of the DPW at the time of original approval, however, construction means and methods have changed over the course of time, and the DPW now does not feel this is a necessary requirement; and, given the foregoing, it seems reasonable to support the request.
2. Request for a Waiver from the Subdivision Rules and Regulations, Section 5 D, and, Request to Modify the Certificate of Action IV 16 which requires a minimum 2.5 Feet of Cover for Drain Structures & Utilities for the pipes between CB 35 & DMH 24 (2.25’), CB 34 & DMH 24 (2.25’); DMH 24 & DMH 23 (2.3’) and DMH 23 & DMH 22 (2.4’).
The Applicant explained that in all cases the pipes were installed within inches of the required minimum depth. In addition, the cover provided exceeds the MASSDOT standards for minimum cover for Class 3 pipe.
The Planning Board made the following findings: The DPW reviewed the certification from the builder as to the class of pipe used, reviewed the MASSDOT standard for minimum cover for Class 3 pipe and finds that the cover provided exceeds that standard; the DPW has no objection to the amount of cover provided and recommends the pipes remain in place; the remedy (excavating the road) would have a detrimental impact on the life of this newly paved roadway and there is no indication of any problems with the pipe; there would be a public benefit in not digging up and damaging this newly paved roadway, and reducing the integrity of the installation; and, this waiver is not inconsistent with the Subdivision Control Law.
3. Request to Modify the Certificate of Action V 7 and Request to Modify the Approved Plans related to Tree Planting within Detention Basin 2-1: The Applicant requests a waiver relating to the planting of trees in detention basin 2-1. The Applicant team explained that the basin is densely vegetated now and in their opinion it would be more disturbance to clear the basin of the existing growth to plant the species identified on the approved plans. In addition, the original intent of the planting plan was to offset the extensive earthworks, and, provide a screening effect for the abutters to soften the view of the development. The existing vegetation provides a landscaped buffer and screen in the opinion of the Applicant team.
The Planning Board made the following findings: These plantings were required in response to public comments regarding screening and were proposed on the basin berm slope nearest to the Bradley Park subdivision, the top of berm was not proposed for plantings; the trees are an aesthetic issue and would not impact the engineering design; and, the invasive vines and species need to be cleared out.
4. Request to Modify the Approved Plans and Request to Modify the Certificate of Action V 7- Lot 5 to remove obligation to install Row of Arborvitae Plantings: The Applicant explained that the plans call for the installation of a row of Arborvitae along the property line of Lot 5 and the “Ryan Lot” on Bradley Park Drive. Lot 5 has been constructed and in-place for several years now and a site visit revealed that there is a significant natural screening currently in place between the lots.
The Planning Board made the following findings: There is existing vegetation in place; clearing to plant does not seem to make sense in this location; this is a low traffic location and fairly private; and, there is no engineering reason for this requirement.
5. Request to Modify the Approved Plans and Request to Modify the Certificate of Action V 7 - Plantings along Rear (South Side) of Lot 26 to accept the plantings as installed. The approved plans had an extensive landscaped buffer called out intended to screen Lot 26 from the adjacent properties, and vice versa. The Applicant team provided photographs of the evergreen buffer they have planted of an arborvitae species that will grow to in excess of 20’ in height and increase in width to provide a screening effect.
The Planning Board made the following findings: The Applicant has installed a row of 6-8 foot tall evergreen screening along the side and rear of Lot 26. Photographs of Lot 26 were reviewed and the Board found that they would provide significant screening for that lot.
6. Request to Modify the Certificate of Action IX 9.4 – Two Vehicle Gravel Parking along Baker Hill Dr. for Open Space: The Certificate of Action and plans featured two parallel paved parking stalls to be constructed between the roadway and the sidewalk in front of Lot 30 for the public to access the open space path. The Applicant requests to construct two parallel parking spaces as shown on the plan titled “Pathway Parking Exhibit” dated 6/30/16, prepared by CHA, Sheet PP1.
The Planning Board made the following findings: The DPW supports the parking as shown on the plan titled “Pathway Parking Exhibit” dated 6/30/16, prepared by CHA, Sheet PP1; and, it is not anticipated that this would impact the overall project drainage.
7. Request to Modify the Certificate of Action IX 9.8 to replace Open Space Post & Rail Fencing requirement with posts and signage: The Certificate of Action required that open space access points be defined by post and rail fencing. The Board has previously issued a waiver to allow that the existing open space access point between lots 23 and 24, which is located in lawn area, be defined through the use of capped 4”x4” posts on both sides of the access path, near the edge of roadway as well as further down the yard slope, with an affixed sign that states “Please Stay on Path”. The Applicant explained that they have created walking paths and installed posts at locations shown on plan entitled “Walkway Figure”, 4/27/16, as revised through 6/6/2016 (“Walkway Figure”), and seek a waiver to allow for the consistent use of this capped post and sign identifier at the open space access points shown on the Walkway Figure.
The Planning Board made the following findings: This is not an engineering or safety issue; and, the Board has approved this in one location already, it is reasonable to support a consistent approach to define open space access points.
8. Request to Modify the Approved Plans and Request to Modify the Certificate of Action IX 9. 9 - Walking Path Construction – Lots 6/7:
The Planning Board had extensive discussion of the walking paths shown on the original Approved Plans and the request of the Applicant to eliminate the construction of the walking paths at running west to east at the rear of Lots 6 and 7. The Board agreed that with required improvements to the other walking paths in the vicinity, removal of the requirement to construct the Lots 6/7 portion of the paths would not be detrimental. The portion to be discontinued is shown in red on the Walkway Figure.
9. Request to Modify the Approved Plans and Request to Modify the Certificate of Action IX 9. 9 - Walking Path Construction – Lots 4, 5 & 6: The Applicant explained that the plans included a proposed walking path that extended from the end of Bradley Park Drive and connected to Baker Hill Drive between Lots 5 and 6 as shown on the Walkway Figure. and stated that it is apparent that if the path were constructed, it would create significant privacy and security concerns at the impacted lots that are crossed. The path would be located within feet of the each of the existing homes on those lots, a distance so small as to deter use. Additionally, construction of a pathway is not practical or safe, given the steep topography that exists.
As discussed in request number 8 above, the Planning Board had extensive discussion of the walking paths and agreed that so long as the walking path extending from the end of Bradley Park Drive across Lots 4 and 3 to Baker Hill Drive was maintained, and subject to required improvements to the other walking paths in the vicinity, removal of the requirement to construct the north/south connection between Lots 5 and 6 would not be detrimental. The portion to be discontinued is shown in red on the Walkway Figure.
10. Request to Modify the Approved Plans and Request to Modify the Certificate of Action IX 9. 9 – Location of Walking Path Construction – Lots 10 - 13: The Applicant explained that the location shown on the plans for the pathway segment behind lots 10-13, if installed as previously approved, would traverse a steep slope leading from the basin down the hill. The natural location for the path, which exists and is readily travelled already, is along the top of the basin berm. The Applicant has installed a crossing over the spillway to facilitate unimpeded travel along the path. The Walkway identifies both the original plan location in red and the actual location established on site as shown in green. The Applicant requests the Board approve the existing path location, as is currently established, on the top of the basin berm instead of the approved plan location within the side slope.
The Planning Board made the following findings: The original location of the walking path is not clear and the path at the top of the berm is flat and established. The crossing over the spillway must be raked down to the elevation required for the spillway. With that modification the modified location of the crossing is a benefit to walkers.
11. Request to Modify the Approved Plans and Request to Modify the Certificate of Action IX 9. 9 - Walking Path Construction – Lot 30: The location shown on the plans for the pathway segment along Lot 30 and the adjacent Open Space, if installed as shown on the approved plans, would impact existing improvements installed by the Lot 32 abutter. As shown on the Walkway Figure, the Applicant proposes to adjust the location of a portion of the path, from Lot 30 to the adjacent Open Space to avoid impacts to existing improvements on adjacent parcels. The figure identifies both the plan location and the proposed location. The Applicant requests the Board approve the proposed, relocated path location which is within the Open Space. The Applicant is currently completing the path connection from the loop at the top of the hill down to Baker Hill Drive through the Open Space and Lot 30, and has installed capped posts at the path entrance.
The Planning Board made the following findings: The relocated path location makes sense from a topography perspective and will ultimately make the path to the top of the hill more accessible and user friendly; and, supporting this request helps support the original intent of keeping access to the top of the hill.
12. Request to Modify the Approved Plans and Request for a Waiver from the Subdivision Rules and Regulations under Section 5 L to Modify the Street Trees 50’ On-Center Both Sides of Street: This waiver request is associated with proposed street trees within Lots 1-4, 7-9, 13, 14 and 30. The Applicant explained that the regulations were different when the project was originally approved and the street tree easement requirement was not yet in the regulations. The cited Lots have obstacles to the installation of street trees including topography, underground utilities, and underground private drainage structures. The Applicant did plant street trees on the section of the roadway and final 12 lots that they developed once they acquired the project.
The Planning Board made the following findings: The Board previously granted a waiver from planting along lots 32-40; the majority of the lots are now developed and in some locations the homeowners have done significant landscaping improvements; the Applicant planted street trees in the areas that they controlled; there is a public benefit in not having private owners install additional trees that may not fit into their developed parcel and existing landscape design; and, this waiver is not inconsistent with the Subdivision Control Law.
13. Request for a Waiver from the Subdivision Rules and Regulations Section 5 M Side Slopes and Request to Modify the Approved Plans - Guard Rail Installation: The Applicant team submitted a letter from John Morgan letter dated February 11, 2016 which was reviewed by DPW. The DPW has accepted his recommendations to install a crashworthy guard rail at location 4, and, that a second rail be installed on the other existing guard rails to provide for better pedestrian protection.
The Planning Board made the following findings: DPW supports this request and accepts the signed and sealed letter from John Morgan, PTOE, from CHA dated February 11, 2016, and the letter from Stephen Makris dated June 8, 2016; a Crash Worthy guard rail should be installed at location 4; A second rail shall be installed on the other existing guard rails to provide for better pedestrian protection in accordance with the recommendations of John Morgan, PTOE; the ROW is wider than typical so the road is a greater distance from the steeper slopes making this an unusual situation; the public benefit is in installing the appropriate guard rails based on current engineering standards as cited by the engineers; and, this waiver is not inconsistent with Subdivision Control Law.
14. Request to modify the Approved Plans - Gas Traps in Off-Road Structures so the catch basins collecting runoff from grass swale areas are no longer required to have hoods installed. The Applicant explained that catch basins in swale areas have the benefit of the vegetation to slow sediment transport and filter the water. As such, hoods are typically not indicated in these areas.
The Planning Board made the following findings: It makes sense to require gas trap/hoods in catch basins that collect runoff from driveway pavement areas whether in-line or at the start of the system; the gas traps in catch basins that collect runoff from driveway pavement areas would minimize hydrocarbons from entering the detention basins, and as such are required to be installed; and, inlets in grass swale areas that do not collect driveway runoff should not require gas trap/hoods because the grass will provide filtration. Gas traps are not required in these structures.
15. Request to Modify the Approved Plans - Lot 32 Drainage: The Applicant is requesting that the drainage pipes on the front of Lot 32 be accepted as constructed. The pipes discharge slightly further east than the location indicated on the approved subdivision plans, and ultimately discharge into a grassed swale within the front yard which is collected at the far end into Catch Basin 26. The drainage pattern and discharge location are consistent with the approved plans and the grass swale is functional, is actively maintained and has not displayed any signs of failure or erosion over the course of our inspections.
The Planning Board made the following findings and identified the following conditions: The swale and drainage adjacent to Lot 32 is part of the private drainage system and will be maintained by the HOA; and, the DPW supports this request.

(b) Remove vines/invasives from Detention Basin 2-1; leave taller robust growth that is providing beneficial shade; pull debris from basin bottom; cut vines at bases of the taller trees where they cannot easily be removed from ground level;
(c) Clear invasives from south “inner” slope to Detention Basin 2-1; plant original evergreen species from the 2000 plan north of the walking path in the identified “gaps” per the attached Exhibit A-1 (Items A.3 & B.2 in 7/11/16 Mod Summary Letter from CHA);
(d) Clear invasives from the north slope facing Bradley Park Drive; cut vines to prevent choking of existing natural cedars, etc;
(e) Clear and remove brush from lower storm water outfall area from Detention Basin 2-1;
(f) Remove the filter fabric currently installed on the inlet side of the control structure within Detention Basin 2-1; and
(g) Cap monitoring well near outfall of Detention Basin 2-1 with a “candy cane” top.

(c) Add sign to fence between Lots 13/14 to direct pedestrians along the path more clearly, and, install coarser wood chips 3’ in width between the wooden posts to identify walking path; and
(d) Two full size paper copies, one 11 x 17 paper copy and a PDF copy of the revised plan sheets that change as a result of this decision shall be submitted to the Planning Board. Applicant shall provide mylars of any revised plans so that they can be endorsed and recorded. The mylars must include a note that specifically references the original Certificate of Action approved January 3, 2000, with recording information, “as amended through the Amended Certificate of Action, approved July 27, 2016, and recorded herewith”.
11. APPROVE the Request to Modify the Approved Plans and Request to Modify the Certificate of Action IX 9. 9 - Walking Path Construction – Lot 30, with the following conditions:
(a) Install timbers into steep section of Lot 30 walking path where it connects onto Lot 32;
(b) Complete the installation of the “Stay on Path” signs on all identified pathway entry posts;
(c) Request that HOA secure maintenance access along common drive for 28 and 29 to maintain open space; and
(d) Two full size paper copies, one 11 x 17 paper copy and a PDF copy of the revised plan sheets that change as a result of this decision shall be submitted to the Planning Board. Applicant shall provide mylars of any revised plans so that they can be endorsed and recorded. The mylars must include a note that specifically references the original Certificate of Action approved January 3, 2000, with recording information, “as amended through the Amended Certificate of Action, approved July 27, 2016, and recorded herewith”.
12. APPROVE the Request to Modify the Approved Plans and Request for a Waiver from the Subdivision Rules and Regulations under Section 5 L to Modify the Street Trees 50’ On-Center Both Sides of Street for proposed street trees within Lots 1-4, 7-9, 13, 14 and 30, with the following conditions:
(a) Two full size paper copies, one 11 x 17 paper copy and a PDF copy of the revised plan sheets that change as a result of this decision shall be submitted to the Planning Board.
