Summary of Proceedings
At a duly noticed meeting of September 26, 2016 Planning Board members Judith S. Sneath, Chairman, Sarah H. Corey, Gary Tondorf-Dick, William C. Ramsey, Clerk and Jennifer Gay Smith heard the application of SLQ, LLC. regarding drainage modifications and driveway relocation at a previously approved single family home site. Bart Foley was present, as was the owner, Shaun Quilty, SLQ LLC. John Chessia was present as peer review engineer for the Board.
Project Description
Mr. Foley explained to the Board what had transpired since the previous approval that resulted in this request for modification of site plan. He said that the test pits had indicated that the soil was not suitable for infiltration, so the drainage plan was modified to tie into curtain drains under the sidewalk, after consultation with the DPW. Mr. Chessia said that this new design should address the concerns about not causing icing of the public way. The swales, as depicted, don’t have much capacity, but DPW is satisfied with the plan. The drainage discharges to the bay, so no rate control is needed. The soils do not have much capacity for absorption in this area, so there will not be much infiltration. Mr. Chessia noted that an erosion control plan should be finalized.
The Board and Applicant discussed the relocation of the driveway away from the street tree, in order to save it. There will also be loam spread over the tree roots to help infiltration. The Board reviewed conditions proposed by the Town Planner, which were compiled from staff comments (fire, police, building, and planning peer review). The Planner said that the latest submittal had not been reviewed because it had been received after working hours the day of the meeting. The Board reviewed the submittal with a focus on drainage and driveway location, and discussed potential conditions. The Applicant will have to revise the plan slightly to respond to the conditions and submit the revised plan to the Planning Board.
Findings and Decision
The Board reviewed the Site Plan Review Criteria and made the following findings:
a. protection of abutting properties against detrimental uses by provision for surface water drainage, fire hydrant locations, sound and site buffers, and preservation of views, light and air, and protection of abutting properties from negative impacts from artificial outdoor site lighting;
Findings:
• The site drainage has been designed to connect to an existing curtain drain, and the DPW is satisfied with the design.
• The design should prevent the occurrence of weeping and icing in the roadway.
b. convenience and safety of vehicular and pedestrian movement within the site and on adjacent streets; the location of driveway openings in relation to traffic or to adjacent streets, taking account of grades, sight distances and distances between such driveway entrances, exits and the nearest existing street or highway intersections; sufficiency of access for service, utility and emergency vehicles;
Findings:
• It is a very steep driveway and sufficiency of access will be addressed further during the building permit process.
• The roadway is narrow and the MBTA bus takes that route, so on street parking would be problematic and unsafe.
• The Building Commissioner provided comments relative to design in a memo dated 9/26/16
Conditions:
1. The house is to have sprinklers installed per discussions with Officer Damstra.
2. All construction parking shall be on the site, or shall be located at another location and the workers will be shuttled in.
3. There shall be no trucks parked on the street.
4. Police details are required during all site construction activity (demolition, tree removal and other construction phases) when required by Police Chief Olsson.
5. The sidewalk shall remain accessible at all times during construction.
6. Applicant must respond to the Building Commissioner comments in the memo dated 9/26/16.
c. adequacy of the arrangement of parking, loading spaces and traffic patterns in relation to the proposed uses of the premises; compliance with the off-street parking requirements of this By-Law;
Findings: Not applicable, single family house
d. adequacy of open space and setbacks, including adequacy of landscaping of such areas;

e. adequacy of the methods of disposal of refuse and other wastes resulting from the uses permitted on the site

f. prevention or mitigation of adverse impacts on the Town’s resources, including, without limitation, water supply, wastewater facilities, energy and public works and public safety resources;
Findings: Not Applicable, single family house
g. assurance of positive storm water drainage and snow-melt run-off from buildings, driveways and from all parking and loading areas on the site, and prevention of erosion, sedimentation and storm water pollution and management problems through site design and erosion controls in accordance with the most current versions of the Massachusetts Department of Environmental Protection’s Storm Water Management Policy and Standards, and Massachusetts Erosion and Sediment Control Guidelines.
Findings:
• The plans must indicate the proposed crushed stone construction entrance, as noted in the write-up, including the detail(s) where the driveway is located.
• The site consists of dense glacial till on a steep slope and will be subject to erosion; in particular fine sediments could flow into the Town system if not properly controlled. If on-site parking for contractors is proposed at this location, the surface proposed should also be indicated.
• The plan should indicate the location and details for the sediment barrier.
• The schedule for construction must be submitted with the general sequence of work prior to the issuance of a building permit.
• Temporary winter protection of exposed slopes shall NOT be hay.
• Contact data should include a 24/7 phone number in case of an emergency.
h. protection of natural and historic features including minimizing: the volume of cut and fill, the number of removed trees of 6 inches caliper or larger, the removal of stone walls, and the obstruction of scenic views from publicly accessible locations;

i. minimizing unreasonable departure from the character and scale of buildings in the vicinity or as previously existing on or approved for the site.

The Board then Moved, Seconded and SO VOTED to Approve Site Plan Review for 170 Otis Street as presented in the hearings and as shown on the plans titled “BUILDING PERMIT PLAN, Single Family Dwelling 170 Otis Street”, prepared by SITEC, DATED April 26, 2016, revised to 8/30/16, with the following conditions:
1. The house is to have sprinklers installed per discussions with Officer Damstra.
