NOTICE OF DECISION-SITE PLAN APPROVAL
REQUEST FOR MODIFICATION TO SPECIAL PERMIT

SUMMARY OF PROCEEDINGS
At a regularly scheduled meeting on November 12, 2014 the Hingham
Planning Board conducted Site Plan Review under §I-G and §I-I of the
Zoning By-Law in Association with a Special Permit A2, relative to the
request for two "minor" modifications to the Special Permit for the
Derby Street Shoppes. Members of the Planning Board present were Gary
Tondorf-Dick, Chairman, Judy Sneath, William Ramsey, and Walter Sullivan
Jr. The intent of the applications is to allow the installation of two
temporary canopies on a permanent, seasonal basis. The applicant
requested the Planning Board consider waiving site plan review.
Ms. Carolyn Kennedy for the Applicant explained the application to
the Board. Prior to considering the issue, the Board reviewed the
substance of the requests and the application materials and determined
that both of these requests represented minor modifications to the
approved Site Plan. The Board felt that they would prefer to complete
Site Plan Review as opposed to waiving Site Plan. The Board then
proceeded to work with the Applicant to understand the mapping submitted
with the August 15, 2014 application, and determined it was adequate
for the request under consideration. Ms. Kennedy explained that the
intent was to formalize approval for the two temporary canopies
currently used on site to be permanent temporary structures, meaning
that the applicant will not have to return annually for approval to
install them. The purpose of the canopies is to provide shade. There
will be no utilities installed. There will be no increased programming
and no change of use from what is happening presently. The Planner
advised Ms. Kennedy that she should contact the Conservation Officer to
determine if additional approvals are needed for the structure by the
pond.
VOTE AND CONDITIONS
After a brief discussion the motion was made, seconded and SO VOTED to
"APPROVE the Site Plan Review for two temporary structures, one 11' x
24' and one 16' x 16', with the following conditions:
1. Canopies to be in the locations indicated on the map provided with
the application dated August 15, 2014, titles "EMPLOYEE PARKING IN THE
SHADED AREAS (Appendix B) The Derby Street Shops, Hingham,
Massachusetts" (attached);
2. permitted between Memorial Day and Labor Day;
3. No additional programming is authorized as part of this approval
